Attorney Services and the local Sheriff’s Department are often the starting point for routine service of legal documents for many law firms.  Based on their pricing structure and volume, these are often the cheapest methods to having a document served.  This is common knowledge in our profession as we regularly receive papers to serve which were already attempted by attorney services and the local Sheriff, but for some reason, the papers did not get served.

From your perspective, and ours, predicting the level of difficulty of a serve at the onset of service can be challenging.  To meet this challenge, and to bridge the gap between hiring an attorney service or the Sheriff’s Department, we created

For routine serves, we charge a flat rate based upon the location of the serve.  If the difficulty of the serve goes up as service is attempted, the pricing structure reflects this change of circumstances. 

Never again will you receive legal documents back which cannot be served, forcing you to find someone else to serve a difficult paper.  

In our profession, encountering old addresses is routine as people often move.  For a routine serve, we charge a flat rate per address, as we sometimes need to check several addresses for the subject.  Upon arriving at an address, from the moment we leave our vehicle, we are in investigative mode, attempting to determine if this is the address frequented by our subject.  We may canvass the neighborhood, talk to neighbors, and many other discreet methods of trying to answer this question.  Many times, prior to arrival, we have already checked property ownership, vehicle ownership, and a host of other background searches, attempting to narrow the scope of locating this subject.  We do charge for using our “information sources” in “a la carte” fashion, but only use them when necessary, and to further the investigation process.

As we work on your routine service, we are also building a dossier for this subject, which allows us to report back to the client on all of the constructive efforts to serve the document.  This dossier can, in turn, be used in a declaration to the court, if needed, should serve by publication be needed.  It can also be used to provide a judge documentation of our attempts to locate and serve a subject who cannot be located, or who is purposefully evading.

From a simple serve at a flat rate, to a more difficult locate and serve, or stakeout, at an hourly rate, plus mileage, we find motivation in getting your document served to further your success in your case.  No matter who we serve, and in the countless number of situations in which they are served, 70% of those we encounter say two words after they are served and before we leave…”thank you.”

# 1 - Identify

Whether you have a rush serve or a routine serve, the first step in attempting to serve someone is to IDENTIFY them.  Working many automobile accident claims, the police report is often the starting point for identifying witnesses to subpoena, and depending upon the condition of the person, this could be limited information.  The best scenario is having the full name of the person (first, middle and last), an address, a date of birth, a driver's license number, a social security number, a telephone number, or the license plate of the vehicle they were driving.  Once we have the name, and one of the other pieces of information, our investigation will have a much greater chance of identifying the correct person.

#2 - Locate

Once the subject is identified, some people are easy to locate, and some people are hard to locate.  An easy locate can sometimes lead to a difficult to locate when subject's have recently moved.  The bottom line is we need a place to start to attempt service.  Knocking on doors, talking to occupants and neighbors, and perusing public records is critical to locating a subject.

If you can't find the witness to your case, it could affect the outcome.  If you can't find the defendant or respondent, the case cannot go forward.  We understand the importance of being able to locate individuals with whom we are attempting to serve.  Once we identify the individual, we use a variety of resources to determine possible home addresses, and possible work addresses, and any other which might lead us to them.  We then make on-site attempts to locate and serve them, talking to neighbors when necessary, running license plates when needed, and scouring public records to narrow the scope of the search.  We have the resources available to work on your difficult locates...and get them served.
